Refund policy

Marceboutique OÜ, registry code 14082579, address J. Sütiste tee 6, Tallinn, 13411, Harjumaa, Estonia (hereinafter referred to as the Seller), and the Client, who places an order in the online store www.marcella.ee and identifies themselves by entering their personal data in the order form (hereinafter referred to as the Client), agree to the following terms and conditions:

1. General Provisions

1.1. The online store www.marcella.ee (hereinafter the e-store) is an online store established by the Seller through which the Seller sells and the Client purchases products offered by the Seller.

1.2. The parties are guided by the Law of Obligations Act of the Republic of Estonia, other applicable laws and regulations, as well as these terms and conditions.

1.3. The Seller has the right to change the content of the e-store, the selection of goods offered, and these terms and conditions at any time.

2. Making a Purchase

2.1. All products sold in the Seller’s e-store are available in the Seller’s warehouse.

2.2. If the product is not available, the Seller will contact the Client and offer a possible new delivery time, replacement with an equivalent product of the same price and quality, or a refund. The refund will be made immediately but no later than 30 calendar days after the order is placed.

2.3. The Client selects the desired products from the e-store, adds them to the shopping cart, fills in the order form, and pays for the products using a suitable bank link.

2.4. An order and payment confirmation will be sent to the Client’s provided email address.

2.5. The Client is obliged to provide true information on the order form, as this is necessary for fulfilling the order. The Seller is not responsible for non-fulfillment of the order or any resulting consequences if the Client has provided false information.

2.6. The order is fulfilled once the Seller has received the order through the e-store and the Client has paid for the order.

3. Placing an Order

3.1. The Client’s shopping cart is created once a selected product has been added to the cart.

3.2. The Client may change the quantity of products, add new ones, or remove them. To place the order, the Client must click “Order,” after which they are directed to the order form.

3.3. After filling in the required information on the order form and submitting the order, the Client will be directed to the order confirmation and payment selection page.

3.4. Marceboutique OÜ is the controller of personal data.

3.5. Marceboutique OÜ forwards the necessary personal data for payment processing to the authorized processor Montonio Finance OÜ.

3.6. The Client can pay by credit or debit card via Stripe.

3.7. Payments are accepted in euros.

3.8. The payment intermediary and authorized data processor is Maksekeskus AS.

4. Client’s Right of Withdrawal

4.1. If the Client wishes to withdraw from the order after placing it but before it has been fulfilled by the Seller, the Client must notify the Seller in writing as soon as possible by email at kontakt@marcella.ee.

4.2. If the withdrawal notice reaches the Seller before the order is fulfilled, the Seller will refund the Client without delay but no later than 14 days after receiving the withdrawal notice. Refunds will be made to the same bank account from which the payment was made. Due to service fees associated with the e-store’s payment solution, 5% of the purchase amount will be withheld.

5. Right of Return

5.1. Products can be delivered by SmartPOST or courier. For international orders, products are delivered to a post office or parcel machine via Packeta Ltd.

5.1.1. For orders within Estonia, delivery to a parcel machine is free if the Client’s shopping cart total exceeds €80 (except in cases described in section 5.5). For orders under €80, delivery costs are covered by the Client.

5.1.2. For international orders, delivery costs are added to the product price.

5.2. Domestic deliveries usually arrive within 3–5 business days from contract confirmation.

5.3. Clients are notified via SMS by SmartPOST when their parcel arrives, including a code to open the locker. International clients are notified by the relevant service provider.

5.4. The Client has the right to return the product within 14 days if it has not been opened or used. Once the Seller confirms the product is unused and undamaged, a full refund will be issued.

5.5. The Client must carefully open the package upon receipt so as not to damage the product or its packaging. If the packaging is damaged, the 14-day right of return does not apply.

5.5.1. If the Client receives the wrong product, a defective product, or a product in poor condition/open packaging, the Seller must be notified immediately by email with evidence (e.g., photos).

5.5.1.1. Instead of returning the product, the Seller and Client may agree in writing on another solution. In such cases, the product no longer needs to be returned, and the Seller must refund the agreed amount within 14 calendar days.

5.5.2. The Seller is responsible for damage or loss of products during transport until delivery to the Client’s chosen parcel machine or post office.

5.6. If the Client does not collect the package within the storage period (usually 7 calendar days), the Seller considers the order canceled. The refund will be made within 14 days, with the Client bearing the full delivery and return costs.

5.7. The Seller is not liable for delivery delays caused by circumstances beyond their control.

5.8. If the Client receives an incorrect order, they must notify the Seller immediately by email. Returns must be made using a return code or as agreed with the Seller. The Seller covers return costs if agreed upon.


    Privacy Policy

1. General Provisions

1.1. The Privacy Policy of Marceboutique OÜ establishes the principles for processing customer personal data. The data controller is Marceboutique OÜ, J. Sütiste tee 6, 13411 Tallinn, registry code 14082579.

1.2. This Privacy Policy applies to all individuals purchasing goods from www.marcella.ee and to all visitors of the website.

1.3. Personal data is used for customer service, fulfilling contractual obligations, and complying with legal requirements.

1.4. All personal data submitted to Marceboutique OÜ is confidential and will not be disclosed to third parties, except as required by law.

2. Data Processing and Access

2.1. Personal data is processed in accordance with this Privacy Policy and the Terms of Sale.

2.2. Data is accessible to Marceboutique OÜ, payment intermediaries, and postal service providers (SmartPOST, Packeta) for delivery purposes. Necessary details (name, phone number, email, parcel locker info) are shared with the delivery provider.

2.3. The payment intermediary processes personal data as part of its regular business.

2.4. Marceboutique OÜ may use third-party service providers for software updates, marketing, payment, and delivery services.

2.5. Marceboutique OÜ may disclose data to supervisory or law enforcement authorities where required by law.

3. Data Collection and Purposes

3.1. Marceboutique OÜ collects data when orders are placed or when individuals subscribe to newsletters.

3.2. To fulfill orders, we require full name, email, address, phone number, and parcel machine details.

3.3. Newsletter subscribers’ emails are used for marketing messages. Only individuals who have consented will receive them. Consent is given via the website subscription form. Unsubscribing is always possible via the link provided.

3.4. Personal data is processed for:

  • customer communication and relationship management

  • contract conclusion and execution

  • responding to inquiries

  • fulfilling orders

  • marketing through newsletters

  • service and website development

  • compiling sales statistics

  • fulfilling legal obligations

4. Data Retention and Deletion

4.1. Personal data is retained as long as necessary to fulfill the customer relationship.

4.2. Data is stored until consent is withdrawn or until legal retention periods expire.

4.3. Upon expiry of the retention period, personal data is deleted.

4.4. After deletion, Marceboutique OÜ no longer retains personal data.

4.5. Clients have the right to request information about their data at any time by emailing kontakt@marcella.ee.

4.6. Clients may request early deletion of their data by emailing kontakt@marcella.ee. The company must respond within 30 days.

4.7. Clients have the right to request correction of data, object to processing, and withdraw consent.

5. Data Protection

5.1. Marceboutique OÜ uses up-to-date security measures to protect personal data from unauthorized access, alteration, disclosure, or destruction. Only authorized persons have access.

6. Changes to the Privacy Policy

6.1. Marceboutique OÜ may amend this policy at any time. Updates are published on the website on the day of approval.

6.2. The valid version is always available on the website.

6.3. For purchases, the version in force at the time of the transaction applies.

7. Client Rights

7.1. Clients may request their personal data and information on recipients, as well as correction or deletion.

7.2. Requests should be sent by email to kontakt@marcella.ee.

7.3. The company may refuse if the identity cannot be verified or if disclosure is unsafe.

7.4. Marceboutique OÜ may decline deletion if processing is required by law, contract, or for legal claims.

9. Complaints

9.1. If a Client believes Marceboutique OÜ has violated their rights in data processing, they may file a complaint to Marceboutique OÜ via kontakt@marcella.ee or to the Data Protection Inspectorate (aki.ee).
